Attorney general seeks dismissal of court motion on 31-year-old conviction

LANCASTER—The Commonwealth of Virginia has asked Lancaster County Circuit Court Judge R. Michael McKenney to dismiss a motion for habeas corpus in the 31-year-old conviction of Emerson Stevens for the murder of Mary Keyser Harding on August 27, 1985.

Senior assistant attorney general Alice Armstrong filed documents with the court last week to dismiss the motion submitted by the Innocence Project of University of Virginia School of Law. Habeas corpus is a recourse in law whereby a person can report an unlawful detention or imprisonment before a court.
