Judge Martin’s decision could shape the future of St. Margaret’s School

A pivotal legal moment is before the Essex County Circuit Court.

Judge John Martin has indicated he will issue a written decision by Monday, April 20, following the April 7 hearing on a motion filed by the Church Schools in the Diocese of Virginia (CSDV) asking the court to dismiss a related lawsuit before it even begins.

In December, seven members of the St. Margaret’s School board of governors, who served during the 2024-25 academic year, filed a lawsuit agains CSDV regarding the closure of the school. The plaintiffs in that suit and other alumnae have formed a new nonprofit, The Foundation for St. Margaret’s School, to continue the school’s operations and to gain ownership of the campus.

A ruling for the plaintiffs would mean the case moves forward with a tentative court hearing date of April 29, according to a press release from Valorie Mundie, interim head of school for The Foundation for St. Margaret’s School. A ruling in favor of CSDV would mean dismissal and the campus sale could proceed unchallenged
