HEATHSVILLE—The Northumberland County Circuit Court convened Tuesday, October 13, with the Hon. John S. Martin presiding.
In the case of Nathan L. Emminizer Sr. of Heathsville, charged with two counts of aggravated sexual battery to a victim 13 years old or younger and sexual penetration using an object to a victim 13 years or younger, post-trial motions were denied and sentencing was set for December 8.
In the case of David I. Ford of Reedville, charged with distributing/selling Schedule I/II drugs for profit, a deferred disposition was set for October 12, 2027. Ford faces $555 in costs and $200 in restitution.
In the case of Dorian D. Howard of Callao, charged with probation violation on a felony offense, bond was granted and a status hearing was set for January 1, 2027.
In the case of Johnny M. Smithart of Heathsville, charged with three counts of spousal rape by force, forcible sodomy to his spouse as a victim, and object sexual penetration upon his spouse, a bond hearing was set for October 27 and a jury trial was set for January19-25, 2027. Smithart also faces two misdemeanor charges of contributing to the delinquency of a minor.
