The Irvington Planning Commission considers updating codes regarding accessory dwelling units

IRVINGTON—With a recent change in the state code regarding accessory dwelling units (ADUs), the Town of Irvington has begun updating its code to comply with the state’s requirements.

The state recently adopted resolutions stating that a locality may not require a rear or side setback requirement for an ADU that is greater than setback requirements for the primary dwelling or accessory structures on the lot, whichever is less.

That same code provides that localities may not impose restrictions on ADUs that are more restrictive than those on single family dwellings in the same zoning area regarding rear, height, or side setbacks.

According to planning commission chairman Tom Chapman, the state implemented these requirements to increase density and affordable housing solutions throughout the Commonwealth. It wasn’t initially expected to have much impact on rural communities, but it ultimately has.

Commission members Steve Strait and Ruth Fuller had drafted several proposed language changes to the existing town code to comply with state requirements…..
