HEATHSVILLE—The Northumberland County Circuit Court convened Tuesday, April 21, with the Hon. John S. Martin presiding.
In the case of David V. Christian of Kilmarnock, a probation violation on a felony offense charge was dismissed.
In the case of Charles L. Elmore of Warsaw, charged with probation violation on a felony offense, the case was continued to April 28.
In the case of Mark A. Monk Jr. of Burgess, two counts of gun possession as a nonviolent felon and receiving stolen/aiding in the concealment of a firearm were nolle prossed. Three misdemeanor charges of receiving/buying stolen goods valued less than $1000, two counts of trespassing to hunt/trap/fish, and hunting/trapping/fishing without a license also were nolle prossed. Monk pleaded guilty to misdemeanor charges of one count of receiving/buying stolen goods less than $1000 and two counts of killing deer in excess of the bag limit. He was sentenced to six months with six months suspended, per guilty charge. Additionally, Monk pleaded nolo contendere to a felony charge of possessing a gun as a non-violent felon. A deferred disposition was set for April 18, 2028. He faces $1,727.25 in costs.
Lakeena O. Noel of Virginia Beach pleaded nolo contendere to four counts of probation violation on a felony offense. She was sentenced to 19 years and four months with 18 years and four months suspended. She faces $213 in costs. She will serve five years of supervised probation upon release.
In the case of Johnny M. Smithart of Heathsville, charged with three counts of raping his spouse by force, forcible sodomy and object sexual penetration, a trial was set for June 16. Smithart also faces two misdemeanor charges of contributing to the delinquency of a minor.
Reminder, those charged with alleged crimes are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
