HEATHSVILLE—The Northumberland County Circuit Court convened for term day on Tuesday, July 28, with the Hon. John S. Martin presiding.
In the case of Daniel J. Banes of Richmond, charged with failure to appear on a felony offense, Banes was not found and the case was continued to October 27. Banes also faces four misdemeanor charges of revocation of pre-trial release on a felony offense.
In the case of Kiwana Y. Garcia of Heathsville, charged with failure to appear on a felony offense, Garcia was not found and the case was continued to October 27.
In the case of Dere’Onta J. Redmond of Heathsville, charged with two counts of probation violation on a felony offense, Redmond was not found and the case was continued to October 27.
In the case of Joshua B. Saddler of Heathsville, charged with probation violation on a felony offense, Saddler was not found and the case was continued to October 27. Saddler also faces four misdemeanor charges for probation violation on a misdemeanor offense.
Robert N. Bibbens of Hague pleaded guilty to probation violation on a felony offense. His probation was revoked and he was sentenced to three years and 10 months with three years and seven months suspended. He also faces $721.96 in costs.
In the case of Charles L. Elmore of Warsaw, charged with probation violation on a felony offense, a status hearing was continued to October 27.
In the case of Kenneth E. Hart of Colonial Beach. charged with two counts of obtaining money under false pretenses of over $1,000 and construction fraud by advanced pay of over $1,000, a show cause was issued and a review was set for October 27.
In the case of Ashley R. Oliver of Heathsville, charged with four counts of perjury by false welfare applications, three counts of larceny by welfare fraud of more than $200, and failure to notify the department of significant change in income, a status hearing was continued to October 27.
In the case of Donte S. Sutton of Lancaster, charged with probation violation on a felony offense, a trial was set for August 18.
In the case of Bradford W. Clayton of Callao, charged with making a false statement on a criminal history consent form, a deferred disposition was set for September 8.
In the case of Kyle T. Jones of Newport News, a possession of a weapon as a violent felon charge was dismissed.
In the case of Johnathan T. Martin of Heathsville, charged with two counts of grand larceny by auto theft, grand larceny of more than $1000 not personal property, and grand larceny, a status hearing was set for October 27.
In the case of Dillon C. Roberts of Lancaster, found guilty of probation violation on a felony offense, sentencing was continued to October 27.
In the case of James H. Slater Jr. of Reedville, charged with four counts of distributing/selling for profit Schedule I/II drugs, a trial was set for September 22.
In the case of Derrick D. Smith of Heathsville, charged with two counts of conducting drug sales near a school or library and distributing/selling Schedule I/II drugs for profit, a status hearing was set for September 8.
In the case of Aaron M. Sullivan, charged with three counts of rape to a victim age 13 or younger and three counts of sodomy to a victim age 13 or younger, a jury trial was set for November 30 and December 1.
In the case of Marcus A. Curry of Kilmarnock, charged with assault on a law enforcement officer, a mental health review was issued and a case review was set for October 13.
Grand jury
A grand jury also convened July 28 and issued the following true bills of indictment.
Eddie L. Gallagher of Mechanicsville was charged with driving with a suspended license while landing his third driving while intoxicated in 10 years. A trial was set for August 4.
Glenn M. Hogan of Lottsburg was charged with driving while intoxicated, third offense. A trial was set for September 15.
Jaqulyn D. Waltman of Callao was charged with three counts of larceny by obtaining a credit card number and two misdemeanors for petit larceny. A plea hearing was set for October 6.
