Supervisors deny rezoning request for River View Contracting site

LANCASTER—Citing future implications and past nonconformance, Lancaster supervisors on Thursday, October 31, unanimously denied a request by Jesse Davis and NN Housing LLC to rezone his Mary Ball Road property from residential to commercial. The 5-0 denial is in line with a March planning commission recommendation to deny the request as well.

Director of planning and land use Olivia Hall said two other C1 commercial and nine other C2 commercial, limited-zoned properties are less than a mile away as well as two other C1 commercial properties approximately a mile away. The property is also adjacent to the county’s Primary Growth Area as outlined in the comprehensive plan.

Hall added that she received 20 letters of support, two petitions of support with 14 signatures and seven anonymous complaints/comments not in favor of the rezoning as well as VDOT staff inquiring why a commercial entrance plan for the property had not been submitted for review.

According to Hall, Davis purchased the 6.843-acre parcel at Chases and Mary Ball roads in September 2021 and has been operating River View Contracting as a home occupation. He originally applied for rezoning in March 2022 and withdrew….
